Chadbourne’s banking and financial services litigation practice group represents domestic and foreign financial institutions in all aspects of litigation, with an emphasis on creditors’ rights. We have recovered hundreds of millions of dollars for our clients on defaulted financings, and have been involved in a number of major real estate foreclosures. When borrowers assert lender liability and related claims, we draw on our considerable experience to successfully defend them. In fact, we have been litigating in this area for almost 20 years, originally during the height of the lender liability boom, and have litigated lender liability cases in two leading states, Texas and California, and other lender liability-friendly jurisdictions. We litigate very aggressively, if and when required. Defense of a Russian bank against claims in New York for more than $100 million under claimed non-deliverable forward currency exchange contracts, brought after the August 1998 Russian banking moratorium and the ensuing Russian financial crisis.

Syndicate of Banks
Representation of multiple lenders on the workout of a senior secured credit facility involving a waste-to-energy project in North Carolina, including extensive litigation and arbitration involving, among other things, the successful defense of lender liability claims.
